These Terms of Service (“Terms”) govern your access to and purchases made through Sanko, a premium online shopping mall showcasing African designers and brands (the “Platform”). By using or purchasing through the Platform, you agree to these Terms. If you do not agree, you must discontinue use of the Platform.
1. Definitions
1.1 “Buyer” means any individual purchasing Products through the Platform.
1.2 “Seller” means any designer, brand, or business offering Products for sale on the Platform.
1.3 “Products” means all goods listed by Sellers on the Platform.
1.4 “Minimum Basket Value” means the minimum order value of GBP 150 required to complete a purchase.
1.5 “Escrow Account” means the account operated by Sanko where Buyer funds are held until released to Sellers in accordance with these Terms.
2. Role of Sanko
2.1 Sanko operates a curated digital marketplace that connects Buyers with contemporary African designers and brands.
2.2 Sanko does not manufacture, produce, or own the Products. The contract of sale is formed directly between Buyer and Seller.
2.3 Sanko facilitates payments and holds Buyer funds in the Escrow Account until delivery is confirmed or the applicable dispute window has passed.
2.4 While Sanko may assist with customer support or dispute resolution, responsibility for the Products rests with the Seller.
3. Buyer Obligations
3.1 Buyers must ensure all order and delivery information provided is accurate and current.
3.2 Buyers are responsible for maintaining the confidentiality of their account and notifying Sanko of any unauthorised access.
3.3 Buyers agree not to misuse the Platform or violate any applicable laws in connection with their purchases.
4. Orders and Payment
4.1 Each order must meet the Minimum Basket Value of GBP 150.
4.2 Payment is collected at the time of purchase and held in the Escrow Account.
4.3 Funds are released to the Seller only after delivery is confirmed and the applicable dispute period has passed. If a valid dispute is raised under Clause 6, funds will be withheld until the issue is resolved.
4.4 Sanko may cancel or refuse an order where misuse, fraud, or a breach of these Terms is suspected.
5. Delivery
5.1 Outbound delivery costs are covered by Sanko unless otherwise stated at checkout. Where applicable, any additional delivery fees payable by the Buyer will be clearly displayed before the order is confirmed.
5.2 Buyers are responsible for return delivery costs unless the return arises from Seller fault, including defects, damage, misdescription, or unreasonable delay.
5.3 Delivery timelines are estimates only and may vary depending on Seller location and international logistics.
5.4 Risk in the Products passes to the Buyer upon delivery. Ownership passes once funds are released from the Escrow Account to the Seller.
6. Returns and Refunds
6.1 Buyers may return Products in accordance with Sanko’s Refunds & Returns Policy.
6.2 Refunds will be issued through the original payment method once the Seller has received and approved the returned Product.
6.3 Where the return is due to Seller fault, the Seller bears the return delivery cost and the Buyer receives a full refund.
6.4 Sanko may refuse a refund where the Product is returned outside the policy, is not in its original condition, or shows signs of wear or alteration.
7. Disputes
7.1 Buyers must notify Sanko within 7 days of delivery if a Product is faulty, damaged, misdescribed, or significantly delayed.
7.2 Sanko may request photographic, video, or other evidence to assess the issue.
7.3 Sanko will act reasonably and in good faith when assisting in dispute resolution.
7.4 Sanko’s determination in relation to disputes shall be final and binding.
8. Intellectual Property
8.1 All rights in the Platform including branding, design, images, and content are owned by or licensed to Sanko.
8.2 Buyers may not reproduce, distribute, or use Platform content for any unauthorised purpose.
9. Limitation of Liability
9.1 To the fullest extent permitted by law, Sanko shall not be liable for:
indirect, incidental, or consequential losses;
loss of profits or revenue;
losses arising from Seller actions or omissions; or
delays outside Sanko’s control.
9.2 Nothing in these Terms excludes liability for fraud, or for death or personal injury caused by negligence.
10. Suspension and Termination
10.1 Sanko may suspend or terminate a Buyer’s access to the Platform where misuse, fraud, abusive behaviour, or breach of these Terms is identified or reasonably suspected.
10.2 Termination does not affect any rights or obligations that arose prior to termination.
11. Governing Law and Jurisdiction
11.1 These Terms are governed by the laws of England and Wales.
11.2 The courts of England and Wales shall have exclusive jurisdiction over any disputes arising out of or relating to these Terms.
12. Entire Agreement
These Terms, together with Sanko’s Privacy Policy and Refunds & Returns Policy, constitute the entire agreement between Sanko and the Buyer regarding use of the Platform.
